You must be at least 18 years old and a resident of a U.S. state where our clinical network operates. By using the Services, you represent that all information you provide is true and accurate.
2. Telehealth Services
Epix TRX is a technology platform that connects patients with independently licensed physicians and licensed U.S. compounding pharmacies. Epix TRX does not itself practice medicine or dispense medications. Clinical decisions are made solely by licensed providers based on your individual health information.
3. No Doctor-Patient Relationship Until Consultation
Browsing the Site does not establish a doctor-patient relationship. A relationship is formed only after a licensed physician reviews your information and accepts you as a patient.
4. Compounded Medications
Compounded medications are not FDA-approved and have not been evaluated by the FDA for safety, effectiveness, or quality. They are prepared by licensed compounding pharmacies pursuant to a valid prescription for individual patient needs. Risks and benefits will be discussed with your prescribing physician.
5. Payment, Subscriptions, and Refunds
- You authorize us to charge your payment method for products and Services ordered.
- Subscription plans renew automatically until canceled in your account.
- Once a prescription is dispensed and shipped, refunds are generally not available except as required by law.
- Consultation fees are non-refundable once the consultation occurs.
6. Shipping and Delivery
Medications are shipped discreetly by our pharmacy partners. Delivery times vary. You are responsible for providing accurate shipping information and ensuring secure receipt.
7. User Conduct
You agree not to:
- Provide false or misleading health information
- Share, resell, or redistribute prescribed medications
- Use the Services for any unlawful purpose
- Attempt to interfere with the security or integrity of the Site
8. Intellectual Property
All content on the Site (text, logos, graphics) is owned by Epix TRX or its licensors and protected by intellectual property laws. You may not copy, modify, or distribute content without permission.
9. Disclaimers
THE SITE AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE SPECIFIC HEALTH OUTCOMES. INDIVIDUAL RESULTS VARY.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPIX TRX SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold Epix TRX harmless from any claims arising from your violation of these Terms or misuse of the Services.
12. Dispute Resolution and Arbitration
Disputes shall be resolved through binding arbitration administered by the American Arbitration Association in Travis County, Texas, except for small claims court matters. You waive any right to a jury trial or class action.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
14. Termination
We may suspend or terminate your account for any breach of these Terms or as required by law.
15. Changes to These Terms
We may update these Terms. Material changes will be posted on the Site. Continued use after changes constitutes acceptance.
